Towards entrepreneurs, these conditions also apply to future business relations without us having to refer to them again. If a trader uses any conflicting or additional terms and conditions, the validity will be rejected. They are only part of the contract if we have agreed to them.
2. Trade Partner, Conclusion of Conctract
- If you choose the payment method PayPal, the contract comes into existence at the time of your confirmation of the payment instruction to PayPal.
- If you choose the payment method Instant Payment, the contract comes into existence at the time of your confirmation of the payment instruction to SOFORT Überweisung.
The available contract languages are German and English.
We save the contract text and send you the order data and our GTC by e-mail. The terms and conditions can be viewed here and downloaded from this page at any time. Your past orders can be viewed in our customer login.
3. Delivery Conditions
Shipping costs are also added to the specific product prices. You will find information about the shipping costs in the orders. You basically have the option of picking up at Spodeco GmbH, Grosmanstr. 4, 50354 Hurth, Germany to the specified business Hours: Mon - Fri 9:00 a.m. – 4 p.m.

By choosing the payment method Prepayment, we will send you our bank information and ship the products after your payment.
Cash on Delivery
By choosing the payment method Cash on Delivery, there will be 3.60€ extra costs. You also have to pay 2.00€ directly to the postman.
SEPA direct debit
If you authorize us a SEPA madate, the payment will be by direct debit from your bank account. The account will be charged when the delivery is made. We will inform you separately in a preliminary announcement of the date of account debit.
The deadline for your advance information about the date the account is debited (pre-notification period) is shortened to 5 days.
You pay the invoice amount through the online provider Paypal. You must be registered there or have to register and legitimize with your login and confirm the payment instructions to us (except possible quest access). You get more information during the order process.
We also offer Instant Payment. There we will get the transfer amount immediately. This speeds up the entire order process. All you need is your account number, bank code, PIN and TAN. Via the secure payment form (not accessible to sellers) the Sofort AG provides an automatic instant payment and generates a transfer in your online bank account. The purchase amount is transferred instantly and directly to the bank account of the merchant. By choosing the instant payment method a pre-filled form will be opened at the end of the ordering process. This already includes our bank details. In addition, the transfer amount and the purpose will be displayed. Now you need to select the country where you have your online banking account and enter your bank code. Then you enter the same date you used registering for your online banking (Account no. and PIN).Please confirm your order through entering your TAN. You will receive a confirmation immediately.
In general every web user can choose the instant payment method as long as they have an unlocked online banking account with PIN/TAN procedure. Please notice that some banks do not offer the instant payment method yet. 5. Cancellation Right
Consumers have the legal right of cancellation described in the cancellation policy. Companies will not be granted a voluntary revocation.
6. Reservation of Title
The goods remain our property until full payment. In addition for companies: We reserve the property of the goods until full payment of all claims from an ongoing business relationship. You may resell the conditional goods in proper business operations; all arising claims from these resale receivables - regardless of a connection or mixing of the preserved goods with a new thing – have to be transferred in advance to us and we accept this transfer. You stay empowered to collect claims but we may also collect claims if you do not meet your payment obligations.
7. Transport Damage
If goods are delivered with obvious transport damage, please complain such mistakes immediately to the postman and please do not hesitate to contact us immediately. The failure of a complaint or contact has no consequences for your legal rights and their enforcement, especially your warranty rights. However, you can help us to make our own claims against transport carrier or transport insurance.
It applies the statutory warranty right. Information on any additional guarantees and the exact conditions can be found on each product and on special information pages in the online shop.
For claims due to damage caused by us, our legal representatives or subcontractors, we shall be liable
- For the loss of life, body or health
- For intentional or grossly negligent breach of duty
- For guarantee promises like agreed
- As far as the scope of the Product Liability Act is opened
In the case of breach of fundamental contractual obligations which fulfillment enables a poroper execution of the contract and on whose compliance the contractual partner can rely (cardinal obligations) due to slight negligence by us, our legal representatives or vicarious agents, the liability is foreseeable in the amount of the conclusion of the contract limited damage which must be expected to incur.
Moreover claims for damages are excluded.
10. Closing Provisions
Are you a merchant according to the Commercial Code, a legal entity under public law or public special fund, the exclusive jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
